LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHARMACY SOLUTIONS, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO USE OF THE SERVICES.

TO THE EXTENT LIABILITY CANNOT BE DISCLAIMED, TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE USER TO PHARMACY SOLUTIONS DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Pharmacy Solutions and its affiliates from any claims, damages, liabilities, losses, costs, and expenses arising from:

• Your infringement of third-party rights

TERMINATION

Termination does not affect accrued rights or obligations.

These Terms shall be governed by and construed under the laws of the State of Texas, without regard to conflict of law principles.

DISPUTE RESOLUTION

Any dispute arising from these Terms or use of the Services shall be resolved in the state or federal courts located in Dallas County, Texas.

You consent to the exclusive jurisdiction and venue of such courts.

CHANGES TO THESE TERMS

Pharmacy Solutions may modify these Terms at any time.

Updated Terms become effective upon posting to the website.

Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.
